Do I have to register if I publish a newsletter on trading commodity futures?
Yes, if you are going to receive any compensation, directly or indirectly, for publishing a newsletter on trading commodity futures you meet the definition of a Commodity Trading Advisor or CTA, above. Thus you are required to register with the CFTC. However, if you do not manage or guide customer accounts, you will not be required to deliver a disclosure document.
CTAs who solely publish newsletters generally need not register with the National Futures Association. Again, given the complexity of this area, it is wise to consult with an attorney experienced in commodities law and regulation.
