The employer is withholding a paycheck claiming there are
damages to smoking within a vehicle that he is going to have
detailed and was angry and gave a mandatory 1 week off without
pay.

Absent an employment contract or union agreement to the contrary, all money earned must be paid. In other words, a company may not withold a paycheck. That having been said, this does not mean that a worker is not responsible for damages caused to company property. If the employee does not pay for damages it caused, then their employer can sue them and/or terminate them.
