Generally speaking the only way that you can be removed from your spouse's insurance policy is Legal Separation, Divorce, Death, Loss of Employment and/ or Open Enrollment. Open Enrollment is when the employed insured has the ability to add or delete parties to his or her policy and you as an employee have the right to switch insurance providers. A spouse does not have a legal right to insurance coverage unless the parties have in some way contracted for it. Call the insurance carrier for your spouse to ask about the specifics on his or her policy. And remember: you can agree to it before the divorce is finalized in a separation agreement and maybe even after you are divorced although that would cost a pretty penny. Good luck.
