This is not an easy "yes" or "no" question.  Can grandparents file for custody of their grandchildren?  Yes, they can.  But a court will not do anything that is contrary to the rights of the parents unless it is in "the best interest of the child."  So really all the facts and circumstances surrounding why you wish to gain custody of your grandchild matter here.  Each case will be judged independently and judged on its facts alone.  So please seek legal help here as to the matter.  Only some one who is fully informed can give you an opinion as to you rights and chances in gaining custody.  Good luck.
