My wife and I own a home. She cheated so I left for a few weeks. Now she lets him stay lets him stay at my house which is now in foreclosure. We have a 17 year old kid; my wife’s but I raised her since she was 1. I’m staying at my mom’s house.

You have not provided sufficient facts to answer your question. The home is in foreclosure and will soon be lost. Is would therefore seem that your interest in the house would be if you are in a position to reinstate the mortgage and save the house. Your marriage is long term and spousal support is a prossubility. The fact that she is living with her boyfriend will reduce her need for spousal support. You should consult with an attorney to discuss the facts and review your options.
