Yes they can. Employment may be denied unless the prospective applicant's treatment is based on their membership in a legally protected class. Such protected classes are those having to do with race, color, religion, sex, national origin, age (40 and over), disability (mental or physical), sexual orientation, plus any other category that a particular state may add. The fact is that as a general rule an "at will" employer has a great deal of discretion in setting the terms and conditions of the workplace, starting with who it hires and why.
