It depends on the circumstances. Not being able to pay or return an item is not necesssarily theft, IF you have no intention to not pay or not return an item you must return. So, for example, say that you could not make your payments because of a lost job or some other problem--if you then return the item, there is no criminal intent and no theft. On the other hand, say you can't make the payments, you are then told to return the item(s)--which you clearly have no right to keep, if you can't pay--but you refuse to return the item(s). In that case, since you are intentionally keeping something which you are not entitled to keep, you are, in fact committing a form of theft.
