If you are struck by another person in a parking lot and alter the story to assist the other driver, it will not usually work out well for you. The other insurance company apparently took a statement from the other driver who gave a different account of the incident. However, whether you witnessed the damage being done, or pretended to receive a note from her, she still struck your car, which would make her responsible for your damages. Even though you didn’t call the police, they may not have come if the accident occurred in a parking lot, so it would not have changed the situation in that way.It sounds as if she may have told her insurance company that she did not hit your car, as that would really be the only reason they would deny the claim. You should talk to the insurance company and see if they will advise why they are denying your claim. If the girl says she didn’t cause the damage, then it is your word against hers, and you will be hard pressed to get them to pay.If she denied the damage, you can take her to small claims court to try to get a judgment against her. If she loses she will have to pay for your damages. At that time she may go back to her insurance company to see if they will pay.
