Can a person driving on a suspended license sue for an auto claim?

My son was in an accident and my insurance company has decided to take responsibility for the claim, however the other party was driving on a suspended license and is attempting to sue

albeit falsely for injuries. I’m questioning this because a citation was issued to the other party on site which basically states he shouldn’t have been on the road since his license was suspended, and he had 3 other passengers in the car.

If the driver with the suspended license was not at fault in the accident, he can sue for property damage (cost of repairs to his vehicle) and on a  personal injury claim for his medical bills, pain and suffering, which is an amount in addition to the medical bills, and wage loss.
