Yes, a non-citizen can own U.S. real estate. As long as they can afford to buy the property. That having been said, there are certain matters that must be dealt with. For example, they would need an Individual Taxpayer Identification Number to use with all theirr tax transactions. At this point, your brother-in-law might want to consult with a real estate attorney for further information.
