Can I buy a home while going through a divorce?
I have a family member that is in the process of a divorce. If they buy a home before the divorce is finalized do they have to split that asset? It is cheaper for them to buy a home then the rent in this current market.

In Massachusetts, all property aquired during th marriage is subject to splitting at the time of the divorce. That being said, if the house is acquired late in the divorce process, there will probably be little to no equity in the house. Also, if the house is being paid for from money that was in bank accounts, that money would have to be accounted for in the divorce anyway, just in a different form.
