Can I create a slideshow video of pictures synced with unlicensed, copyrighted songs that will be played by a non-profit church/school at a graduation ceremony?
Although copyright law appears to provide an exemption for the nonprofit organization to perform/play the copyrighted music without licensing it (Ch 1, Sec 110, paragraph 5), I am concerned that as an individual I may be liable for physically reproducing the copyrighted material to make the DVD the church/school would play.

Based upon what you have written about, you can do what you intend to do but you and the organization that you are doing the program for could very well be subject to copyright infringement absent getting written permission to use the copywritten songs for the person or entity that owns such.
