What could and should happen are two very different things. Technically speaking, you shouldn't be eligible. However, sometimes they won't notice and offer defensive driving again. Before you go to the expense of hiring an attorney, you may want to inquire to the court coordinator "hey, what am I looking at." Don't divulge anything about having the prior ticket...just them you want to know what they offer. There is a chance that they will offer the same thing. If they offer something different, then seek out an attorney to help you potentially broker a better deal.
Understand, that even though you probably shouldn't get another chance at deferred under some court's policies, it doesn't mean that all court prosecutors will have the same policy.
