Under the laws of all states in this country, there is nothing prohibiting one from serving the father or mother of a child a petition for child support if he or she is an illegal alien. The possible problem is that the parent who is an illegal alien may be deported from this country making child support collection difficult if the monthly payments are not made voluntarily.
