Yes, you can in many states as long as you qualify under the law as a disabled person entitled to benefit under the law that allows a Special Needs Trust. There are two kids of SNT's and you should speak with an attorney familiar with drafting these documents to insure that it is properly done. What you want is a "self-settled" trust if your state law so allows. Good luck.
