The way to try and stop a wage garnishment with respect to your wages served upon you employer is as follows:
1. file a claim of exemption with the court where you will be given a hearing date to state your claim before the court. The court will make a decision based upon your claim.
2. try and enter into a written payment agreement with the judgment creditor in lieu of the wage garnishment and adhere to the agreement's terms.
Note, under the laws of all states in this coutnry, the typical amount allowed to be garnished as to one's wages is 25% of the judgment debtor's net pay per each pay period.
