Can I submit my tenant’s background check to the HOA even though my tenant is telling me no?
Our property rules/regulations/bylaws state that I need to submit background screening information. Can my tenant restrict me from sharing that required information?

If your tenant does not authorize your provision of the background check to the HOA you are under no obligation to adhere to the tenant's request for the simple fact that you can unilaterally order a background check on anyone without advising that particular person that a check is being made as to him or her.
