Can I sue my ex-husband for the wrongful death of our son?

Our son was visiting his father. He entrusted his stepson to drive our son in my ex-husband’s underinsured car. So that when our son died, my insurer and the driver’s insurance virtually went into a pool that both of us had to share. His insurance rejected his claim because he didn’t have life insurance attached. The insurance company that handles both my ex-husband and his stepson, stated that they were legally not liable to pay twice for the same accident. Even though they are 2 different policies.
