That depends on a few things, and perhaps the most important is where you plan to go on vacation, with your spouse's ideas about this coming a very close second.
In almost every case, if your spouse agrees, you can do what you want. And in most states, if your vacation isn't out-of-state, the courts will approve it anyway.
