Unless this worker has a union agreement or employment contract providing otherwise, you can terminate them, with or without notice. In fact, in an "at will" employment arrangement, a worker can be discharged for any reason or no reason at all. Bottom line, absent some form of legally actionable discrimination, a business can set the terms of employment much as it sees fit.
