I am sorry for your situation.  So wht you are saying is that you help pay for things there, correct?  Can we charachterize you as a "subtenant" on his tenancy?  It may not be allowed under his lease but I would take that stand legally here.  Then I would say that he has to evict you.  But think about how this will effect you and the kids.  Good luck.
