We formed an scorp and a DBA and now he is operating under a different name.

If he owned more than 50% of the business, he could do this, since a more-than-50% owner can unilaterally make decisions of this nature. Or if the operating agreement(s) under which the two of you were operating the business gave him the authority to do this.
