Long story short my husband ran off with our new born son. He now has a warrant for interfering with custody; can he get custody with a warrant out for him?

It is entirely possible under the laws of all states in this country that even though your husband took off with your new born son and has an outstanding arrest warrant for such pending, he can file for custody for your child, be it joint or sole.
Whether or not he gets custody in some shape or form with respect to your child depends upon what the judge decides based upon the facts and evidence concerning the underlying child custody matter.
