My husband and I have been divorced for about 3 years. We have since reconnected and are moving into an
apartment together. Can we sign the lease as married since we will be getting remarried and I still have his last name?

No, you cannot, not if you are not married at the time you sign it. To sign as married when you are not is fraud; if the landlord discovers it, it would be a basis to evict you while still holding you liable for all the rent due under the lease.
