A person cannot legally enter in a marriage if they are still married to someone else. If they do, then the second "marriage" is null and void. This means that in the eyes of the law it is as though that mariage never took place. What your "husband" needs to do now is to confirn that his divorce is actually finalized. Then, you need to "re-marry".
