Although many states now allow the child to bring an action against the parent for failure to pay child support, there is generally a time frame with in which the child can do so known as a statute of limitations. You need to check what that is in your state. Now, if your Mother obtained a judgement against your father for failure to pay support then that judgement is enforceable even upon his estate.
