There is no hard and fast rule. If you and your neighbor cannot work out any tree-related issues among yourselves, a court would have to make the call. A court would look at factors like how much of the tree is on each of the line; who planted it originally, if that can be determined; even if it's grown so that more is now on the neighbor's side, which yard was it initially planted in (if that can be determined); who, if anyone, has paid for tree care in the past, which implies that person believed it to be their tree; etc.
