It is perfectly legal--maybe not fair, but legal. Employment in this country is "employment at will"--that means (among other things) that an employer is completely free to decide who to hire and who to not hire, for essentially reason any reason whatsover. The law does not make it illegal to refuse to hire someone due to a criminal charge or record; therefore, the employer can refuse to hire you for this reason.
