The EEOC filed the charge with me against the employer and said I can use an attorney if I want. What could I gain? What would I need to do to sue for damages?

The EEOC process is administrative in nature. You can also most likely try to follow civil litigation rights. Either way, it is always a good idea to have a lawyer exclusively representing your interests.
