The facts here will matter in the determination. There is no definitive answer - yes or no - at the outset in these types of cases because courts often have to balance an employers rights (and yes they have them as well as obligations of safety to other employees) against your right to privacy. Missouri does not appear to have a law specifically on point. Public employees have a greater protection of privacy provided by the United States Constitution.
