You were very lucky as I am sure that you know. I always think that it is better to go before the court with an attorney in these situations and to show the remorse that I know that you must have for this momentary lapse in judgement. Many states have a zero tolerance for these offenses with good reason. And although an attorney may not be able to alter your penalty, he or she can make sure that you are treated fairly. Here are the penalties for first offense:
- Up to .17: 91 days' suspension
- .18 or greater: 180 days suspension
- (in both cases, work permit is possible after 30 days.)
- Minimum fine of $250
- Mandatory referral to addiction facility for alcohol evaluation
- Higher automotive insurance
