An employee must be paid for all hours worked. If you have not been paid all that you are owed you have rights. In TN, if an employee was fired then their final paycheck must be given on the next scheduled payday or within 21 days, whichever is later. If the employee quit, their final check must be given on the next scheduled payday or within 21 days, whichever is later. At this point, you can either file a wage claim with your state's department of labor or sue your ex-employer in small claims court (if you win you will be awarded filing fees and any related costs).
