My brother just past away and he had custody of his son. He was divorced and the mother didn’t want the child.

I suggest that you consult with a family law attorney to see what can be done as to you getting custody of the minor son where your late brother presumably had 100% physical and legal custody. From what you have written a petition to the court seeking what you desire in the county where the minor resides seems to be in order.
