How can I make my husband move out of this apartment?

There is no lease. We were paying bills together. I do not want to live with him
any more.

Until there is a formal separtion agreement or final decree of divorce that states who has the right to possession of the premises, it remains the "joint marital residence". This means that you both have the right to occupy it. In the meantime, you have no right to change the locks, remove his belongings, etc.
