You can find out if his estate was probated by finding out whether a case was filed in the probate court for the county where he lived. If no probate has been filed, it will be more difficult to find out if he had a Will. Wills are almost never filed before a person dies. The Will, if it exists, could be among your brother's important financial papers, in his lawyer's possession, or in a safe deposit box at his bank.
