How do I get my sister to leave my house?

She pays no rent, is not on my lease but she had mail come here. She is very combative and will not leave.

The best way to get your sister who is occupying the place that you live in where she has no written lease is simply serve her with a thirty (30) day termination of her lease. Under the law, she is on a month-to-month lease.

If she does not vacate in the thirty (30) day time period, then you will need to file an unlawful detainer action in your county court house. If things come to that point, you should consult with a landlord tenant attorney.
