What to do if I am being accused of video recording in a public bathroom?

The police have not issued a warrant to seize my phone or brought charges against me. I have personal photos of my partner and myself on my phone and would feel uncomfortable allowing others to see them. By law, can I erase these photos? What would be the repercussions of getting a new phone and throwing the other away?
