What to do if I need to file an emergency custody hearing (ex parte) to keep my children from having to go with their father?
The court is closed and he is supposed to pick them up tonight for the holiday. There has been a report of physical abuse made with the police and child protective services and it is currently being investigated. I am in fear for their safety if they go with their father tonight.

If you are fearful of the fact that your children will be with their father, you need to immediately consult with a family law attorney to go in on an ex parte basis for a restraining order against the father. Be prepared to be specific as to the reasons for the request as well.
