If I’m the primary caregiver of my son and his father has visitation every other weekend, can I move out of state with our child?

It’s in the child’s best interest to continue living with me.

If you are unable to reach a consent agreement with you child's father then it may be up to the Court to determine what the child's best interests are. A court can not force you to stay in North Carolina, however a Court can say that it is in the child's best interests that the child continues to reside in NC therefore saying if you move be out of state then primary custody goes to father.
