Yes, you can be. You could potentially be charged with assault (since you obviously struck another person, which is assault), and if the other person truly takes a turn for the worse and passes away, you could potentially be charged with negligent homicide or manslaughter--charges are not uncommonly upgraded in response to how the victim does medically.
