The fact is that not all employers provide severance pay and those that do may not provide severance pay to all employees. As a general rule, it is issued on a case-by-case basis. For example, if it is required under an employment contracts or union agreement, etc. There is no law that mandates employers provide such pay however, the FLSA Fair Labor Standards Act requires that an employer must pay an employee whose employment has been terminated through their last day of work and any vacation time that the employee has accrued.
