I have paid thousands of dollars out of pocket and I am still paying. Can I sue them?

You can sue the auto body shop for breach of contract and breach of warranty. These are separate causes of action (claims) in your lawsuit. Your damages (monetary compensation you are seeking in your lawsuit) would be the thousands of dollars in out of pocket expenses you have incurred caused by the breach of contract / breach of warranty by the auto body shop.
