He and she both could potentially sue you:

Him--if he claims (as is not unlikely) that you are lying, he may try to sue you for defamation, which is making an untrue negative factual statement about a person, which damages his reputation. You may be able to win, if you can prove the relationship, but do you want to have to defend against this lawsuit?

2) Her: if the revalation or the affair breaks up the marriage, she may try to bring an "alientation of affection" lawsuit against you (NC is one of the very few states still allowing this).

You could also find yourself a witness in any divorce proceedings, with all the stress, distraction, bad publicity, etc. that entails.
