Unless there is a court order precluding you from taking your minor child with you on an out of state move, you seemingly can do such. Before you make the move, I suggest that you consult with a family law attorney as to your intent and what you should do with respect to the intended move and rely upon the attorney's advice as to written notice to the father of such or a petition with the court seeking permission to do what you desire.
