Did you illegally use her social security number to obtain this background check? If so, you can be considered criminally liable for identity theft. Yes, if she finds out somehow, you can be sued and charged. The lawsuit will be for identity theft, any harm to her credit or privacy and invasion of privacy. Criminally, the same line of charges could be apply.
