What to do if I want to have my son’s father sign over his rights?

He abandoned him here about 2 years ago and has only seen him when I fly to the state in which he lives. He hasn’t paid child support completely and I know he does drugs and is unstable. I want my son to have my last name and if I were to pass on I have the right to say where my son goes.

I suggest that you consult with a family law attorney to assist in the matter that you have written about where the biological father of your son signs a document to be filed with the court where he gives up all physical and legal custody as to the minor. You do not want to waive any rights for child support of the child from the father.
