I had just recently put in a new transmission and rebuilt the head of the engine which cost me around $2,500.

If you disagree with the property damage settlement offer from the insurance carrier for the other driver, you can reject the settlement offer. If the property damage is not settled, your recourse is to sue the at-fault driver/registered owner of that vehicle for negligence.
