In fact it is both. It can be considered insurance fraud and any type of fraud is illegal. What will happen is that the claim will be denied when it is submitted (you notified your insurance company about the change in the marital status, correct?) and then she will be billed for it. You need to make sure that your health provider is aware of the situation to protect yourself. Good luck.
