Here is the thing: the seller is not a party to this "gift" arrangement and the seller can come after the "giver" who is really the owner and probably you to get the gift back. If you want to keep this consider paying it off yourself. Good luck.

Under the laws of all states in this country assuming a gift is given to a third party without any restrictions, then the person receiving the gift gets to keep it as is. The giver is then obligated to whomever he or she owes money to in the acquistition of the gift.
