What to do about a personal injury incurred by the negligence of a national retain chain’s employees?
I was in a national retail chain shopping. I was not doing anything wrong. I was reaching for some hot dogs and had my back turned. A couple of employees were bringing out stock and boxes fell on me and injured my calf; a contusion to my aceleis tendon. I was limited to the bed or TV and had to to wear a boot for 4 1/2 weeks. Additionally, I was not able to drive and was restricted weight bearing on it. The store does not want to work out a realistic deal. What do I do? Should I speak with a person injury attorney? Yes you should if you desire to pursue the matter any further. You do not necessarily have to have a lawyer in the exact county. Most attorneys will take on cases in more than one county and some many counties and depending on the case, some will go statewide or out of state. The standard you must prove, by a preponderance of the evidence (51% or more likely than not) is that the store employees were negligent in failing to properly secure the boxes for travel throughout he store, failure to take proper precautions to lookout for patrons in the store and failure to keep safe distances from the load, in stacking the boxes too high and insecurely. It sounds as if you have a viable case from what you have written keeping in mind I do not know the entire story. So yes, hire a lawyer in Texas and pursue the matter if you would like.
